Terms of Service

1. Acceptance of terms

These Terms of Service govern your use of the Yagr websites and applications (together, the Platform). By accessing or using the Platform, creating an account, or publishing a listing, you agree to these terms. If you do not agree, do not use the Platform.

2. Who we are

The Platform is operated by Fermain Pty Ltd, trading as Yagr (we, us, or Yagr). Seller and agent listing tools may be provided on a separate subdomain (for example platform.yagr.app) that forms part of the same service.

3. Description of services

Yagr is a South African property search and listing service. We help buyers and renters discover properties through natural-language search, map-based browsing, saved hunts (personalised feeds), and listing detail pages. We help sellers and estate agents create and manage listings, including assisted drafting tools.

Search results are ranked by relevance to your query. We do not sell paid placement in search ranking. Property information may include deeds-derived data, price history, and third-party sources; it is indicative only and may be incomplete or out of date.

We may change, suspend, or discontinue features with reasonable notice where practicable. Beta or preview features may be offered as-is.

4. Accounts and registration

Certain features require a registered account. Sign-in is provided through Google OAuth (or, in non-production environments, a developer sign-in intended for testing). You must provide accurate information and keep your Google account secure. You are responsible for activity under your account.

We may refuse registration, suspend access, or close accounts that breach these terms or pose a security or fraud risk.

5. Listings and content

If you publish or manage listings, you represent that you have authority to market the property and that your descriptions, photographs, pricing, and status are accurate and not misleading. You must comply with applicable estate agency, consumer protection, and advertising laws.

You retain ownership of content you submit. You grant Yagr a non-exclusive, worldwide licence to host, display, adapt (for example resizing images), index, and promote that content as needed to operate the Platform, including in search results and share previews.

We may remove or moderate listings or other content that violates these terms, applicable law, or our policies, or that we reasonably believe harms users or the integrity of the Platform.

6. Payments and fees

During our launch period, property listings are free until 31 May 2027. After that date, a monthly listing fee applies at the rate published on our Pricing page when you activate or renew a listing. Fees are charged for each month (or part thereof, as described on Pricing) that a listing remains live. Withdrawing or deactivating a listing stops future monthly charges for that listing.

Payments are processed by our payment provider. You authorise us and our provider to charge the payment method you supply. Receipts and payment failures are communicated by email. Pricing excludes VAT unless stated otherwise; applicable taxes may be added where required.

Cost estimates shown on listing pages (for example transfer duty or bond repayment illustrations) are for convenience only and are not financial, tax, or legal advice.

7. Acceptable use

You must not:

  • use the Platform for unlawful, fraudulent, or deceptive purposes;
  • publish false, misleading, or duplicate listings, or impersonate another person or agency;
  • scrape, crawl, or harvest data from the Platform without our written permission, or attempt to bypass access controls, rate limits, or demo gates;
  • interfere with the operation of the Platform, probe systems without authorisation, or upload malware;
  • use automated means to manipulate hunts, reactions, or rankings, or to harass other users.

8. Intellectual property

The Yagr name, branding, software, and design are owned by us or our licensors. Except as expressly allowed by these terms, you may not copy, modify, or create derivative works of the Platform.

Map tiles and attribution are provided by third parties (including OpenStreetMap contributors). Your use of maps on the Platform is also subject to those providers' terms.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free search, or that any listing will result in a sale or lease.

We are not an estate agent, broker, or financial institution. We do not verify every statement in a listing, guarantee title, or participate in negotiations between buyers and sellers. You should independently verify material facts before making decisions.

10. Limitation of liability

To the fullest extent permitted by South African law, our total liability to you for any claim arising from or related to the Platform is limited to the greater of (a) the fees you paid us in the three months before the event giving rise to the claim, or (b) R1 000.

We are not liable for indirect, consequential, or special damages, or for loss of profit, data, or goodwill. Nothing in these terms limits liability that cannot be limited by law (including where consumer protection law applies).

11. Termination

You may stop using the Platform at any time. We may suspend or terminate your access if you breach these terms or if we discontinue the service. Provisions that by nature should survive (including licences granted for content already published, disclaimers, and liability limits) remain in effect.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. You submit to the exclusive jurisdiction of the South African courts, subject to any mandatory rights you have under applicable consumer law.
